These terms are not yet effective and do not change existing bookings. No acceptance is collected on this page.

1. About these terms
XWheels is a Malaysian vehicle rental marketplace operated by Helios Capital Sdn. Bhd., company registration 202601012737 (1674835-A). It connects customers with vehicle operators in Johor Bahru, Johor, Malaysia. "We" means the company. "You" means the customer or renter.
This page is a draft for review. It does not take effect or create acceptance through continued browsing. Once final terms are published, they apply only through the acceptance process presented to you. The version disclosed and accepted for a booking forms part of that booking record.
These terms cover customers. Operators have a separate agreement with XWheels. Applicable Malaysian law takes priority over any inconsistent provision.
2. XWheels and your vehicle operator
The vehicle operator identified for your booking supplies the rental vehicle. The operator is responsible for its rental obligations, including the vehicle, handover, and the conditions it agrees with you. XWheels provides the marketplace and the platform services described during your booking.
Operator conditions must be available before you commit and must comply with applicable law. An operator cannot remove your mandatory consumer rights through its own conditions.
XWheels remains responsible for its own services, representations, and legal obligations. The marketplace model does not exclude responsibility that the law places on XWheels.
3. Eligibility and approved drivers
You must have legal capacity to enter into the rental contract. Each driver must hold a valid driving licence recognised in Malaysia for the vehicle category and meet the operator and insurer conditions disclosed for that vehicle.
Bookings require an approved customer identity verification and an account that is not suspended. Verification approval does not replace the driving licence or other eligibility checks required for a particular rental.
Give accurate identity and licence details. Tell the operator if a licence expires, is suspended, or changes before or during a rental. Only drivers approved under the booking and applicable insurance conditions may drive.
4. Your account and security
Keep your account information current and protect your login details and verification codes. Do not impersonate others, falsify documents, or share your account to bypass verification.
Contact support promptly if you suspect unauthorised access or an incorrect booking or payment. We assess disputed activity using the available evidence. Responsibility for misuse depends on the circumstances, fault, and applicable law. These terms do not make you automatically liable for every action performed through your account.
5. Booking requests and confirmation
Availability, minimum and maximum rental periods, collection arrangements, and operator approval requirements depend on the vehicle. Review the vehicle details and booking summary before submitting a request.
A request or payment step does not, by itself, confirm a rental. Follow the booking status and confirmation communicated through XWheels. Do not collect or use a vehicle until the booking is confirmed and the operator has completed the required handover checks.
The booking record includes the agreed rental period, recorded charges, deposit, and applicable cancellation conditions. Extensions, vehicle substitutions, and other material changes require agreement and an updated record, including any resulting price change.
6. Prices and payments
Prices are in Malaysian ringgit, shown as MYR or RM, unless expressly stated otherwise. Check the rental price, service fee, deposit, and other disclosed charges in the booking summary. Any applicable taxes and whether they are included must be disclosed before you commit.
Use a payment method you are authorised to use. A card authorisation may reserve funds without collecting them. Authorisation, payment capture, and booking confirmation are separate steps.
Additional payments must have a lawful contractual basis. These terms do not grant a general right to charge a saved card for any amount claimed by an operator.
7. Security deposits
The booking summary records the required deposit. Review who collects and holds it, the collection method, the permitted deductions, and the return process disclosed for your booking.
A proposed deduction must identify its basis and supporting evidence. You may dispute deductions. A deposit is not automatically an insurance policy, an escrow arrangement, or a limit on lawful liability. Return of a deposit or release of a card authorisation follows the applicable booking conditions and payment process, subject to your statutory rights.
8. Cancellations, changes, and refunds
Review the cancellation conditions recorded for your booking before accepting it. They govern voluntary cancellations and changes, subject to applicable law. Contact support if you cannot use the cancellation process or believe the recorded conditions are incorrect.
A cancelled booking status does not mean a refund has already been issued. Refund eligibility, approval, and payment processing are separate matters. Request an explanation of any retained amount.
If the operator cannot supply the agreed vehicle or service, contact support about the available remedy. You do not have to accept a substitute or a new price without agreement. Any contractual cancellation condition remains subject to statutory remedies for non-supply, misrepresentation, or defective services.
9. Vehicle handover and return
Attend the agreed collection and return arrangements with the required documents. Inspect the vehicle with the operator. Record existing damage, fuel level, odometer reading, accessories, and any safety concern using the handover record and photographs. Check the record before signing.
Do not drive a vehicle you reasonably believe is unsafe. Report the concern to the operator and support so the issue and any remedy can be assessed.
Return the vehicle, keys, and agreed accessories at the agreed time and location. Record the return condition, fuel, and odometer reading. Request approval for an extension before the rental ends. Late return, fuel, and mileage charges require the basis disclosed for your booking.
10. Safe and permitted use
Drive lawfully and safely. Follow road rules, vehicle capacity limits, and the disclosed operator conditions. Do not drive under the influence, race, use the vehicle for unlawful activity, tamper with safety equipment, or continue driving after a warning or defect makes driving unsafe.
Do not sublet the vehicle or use it for commercial passenger, delivery, or other commercial work without the required operator approval and lawful insurance coverage. Follow the agreed restrictions on roads, parking, smoking, pets, and vehicle care where disclosed before booking.
11. Travel areas and cross-border journeys
Use the vehicle only in the Malaysian areas permitted for your booking. A rental in Johor Bahru does not automatically permit travel throughout Malaysia or entry into Singapore.
Travel to Singapore or another country requires the operator's prior written consent and all required legal, registration, permit, and insurer approvals. Check the applicable border requirements before travelling. Do not cross a border until every required approval is in place.
12. Accidents, breakdowns, and theft
Put personal safety first. Contact the relevant emergency services when needed. Notify the operator promptly about an accident, theft, breakdown, or material damage. Notify the police, insurer, or other authorities when required by law or the applicable policy.
Preserve relevant photographs, reports, and contact information where safe and lawful. Cooperate reasonably with the investigation and claim process. Avoid unauthorised repairs or recovery arrangements unless necessary for safety or required by law, and keep receipts.
Check your booking for the actual recovery or assistance arrangements. XWheels support is not an emergency service and these terms do not promise roadside assistance.
13. Insurance and protection
Before driving, review the written insurance information applicable to the vehicle and rental. Check the insured drivers, permitted use and travel areas, excess, exclusions, and claim procedure. Ask the operator for clarification if coverage is unclear.
A vehicle listing or identity check does not itself provide insurance. XWheels does not become an insurer by displaying a vehicle. Any insurance or optional protection must be supported by its actual written terms.
14. Damage, tolls, fines, and other charges
You may be responsible for attributable tolls, parking charges, traffic penalties, and other lawful costs arising during your rental. Any administration charge must have a valid basis and be disclosed where required. The operator must provide enough detail to explain the charge and connect it to your rental.
Damage claims must consider the handover and return records, pre-existing damage, normal wear, and relevant evidence. You are not responsible for pre-existing damage or normal wear merely because a claim is raised after your rental.
You may accept or dispute a damage claim and provide your evidence. Request an itemised explanation of the loss. Recovery must reflect lawful responsibility and must not duplicate insurance proceeds or another recovery for the same loss.
15. Responsibility and consumer rights
Each party is responsible for loss to the extent caused by its breach, negligence, or other legally recognised fault. Any claim must establish its basis, causation, and reasonable amount. A claimant must take reasonable steps to limit avoidable loss.
Nothing in these terms excludes or restricts rights or remedies that cannot lawfully be excluded, including applicable rights under the Consumer Protection Act 1999. Nothing excludes liability for fraud or liability for death or personal injury caused by negligence where such exclusion is unlawful.
16. Reviews and platform content
Submit honest reviews based on your own experience. Do not post threats, unlawful content, misleading claims, or another person's private information. You retain ownership of your original content.
You give XWheels permission to host, display, and technically adapt content you submit as reasonably needed to operate the service and show your review. This permission does not create a general licence to use identity documents or private booking material in marketing. We may remove content that breaches these rules and explain the reason where reasonably possible.
Do not copy platform branding or content for an unauthorised commercial service, interfere with platform security, or misuse another person's data.
17. Personal data
Our privacy policy explains the personal data used for accounts, verification, bookings, payments, safety, and support. We handle personal data under the Personal Data Protection Act 2010, as amended, and other applicable requirements.
An operator may need relevant information to supply the rental and meet legal or insurance obligations. The privacy policy describes applicable disclosures and your privacy rights. Acceptance of these terms does not itself provide consent to unrelated marketing. Any consent required for a particular purpose must be obtained separately.
18. Account restrictions and service access
We may restrict access where reasonably necessary to address fraud, safety, unlawful conduct, material breaches, or a legal requirement. Any restriction should be proportionate to the issue. We provide a reason and an opportunity to request review where lawful and practicable. Urgent protective action may precede notice.
A restriction does not erase an existing refund entitlement, a valid dispute, or your statutory rights. Contact support about an affected confirmed booking.
19. Complaints and Malaysian law
Send complaints to support@xwheels.my with your booking reference, a description of the issue, and relevant evidence. Do not send passwords, verification codes, or full payment card details. We will review the matter and explain the next steps.
Malaysian law governs these terms. Disputes may be brought before Malaysian courts with jurisdiction. You retain the right to refer an eligible claim to the Tribunal for Consumer Claims Malaysia or another competent authority. Contacting support is not a condition that removes or delays a statutory remedy or filing deadline.
20. Changes and contact
We may publish revised terms for future use and bookings. Material changes must be brought to your attention with an appropriate acceptance process where required. A later version does not unilaterally rewrite the terms of an existing confirmed booking.
If a provision is unenforceable, the remaining provisions continue only to the extent lawful. Any replacement or interpretation must preserve mandatory consumer protections.
For questions about these terms, contact Helios Capital Sdn. Bhd. at support@xwheels.my. The draft update date above is a document revision date, not an effective date.
